Private Plan Change 05/03 & 05/04

Following a hearing on 18 December 2006, and the close of appeals with no appeals being lodged, the two Private Plan Changes 05/03 and 05/04 (as amended) became operative on 5 June 2007.
Background
Nelson City Council received requests from Stoke Valley Holdings and Solitaire Investments Ltd for a change to the Nelson Resource Management Plan (NRMP), pursuant to Clause 21 of the First Schedule of the Resource Management Act 1991. The Council resolved to proceed with notification of this private plan change. The proposed plan change was publicly notified on 24 June 2006 .
The two plan changes involve the rezoning of a total of approximately 190 hectares in the Ngawhatu valleys to provide for planned and sustainable growth for residential development in this part of the City.
The Stoke Valley Holdings Ltd Change (Proposed Change 05/03) involves the rezoning of approximately 52 hectares from an existing Residential zone, covered by a special schedule, as well as an area of Rural zoning, to be largely incorporated into the Standard Residential zone with provision for a high density Residential area within the zoning. In addition, an area is to be zoned for Suburban Commercial purposes. The legal description of the subject property is Lots 1 to 35, DP 353023.
The Solitaire Investments Ltd Change (Proposed Change 05/04) involves the rezoning of approximately 138 hectares of land from Rural to Residential, including a small area of High Density Residential land and an area with a Higher Density Small Holdings zoning. This land lies between the two Ngawhatu valleys of Highland Valley and York Valley. The legal description for the land is Lots 36 & 38 DP 353023, and Part of Lot 37 DP 353023, CT 233530.
Submissions closed on 24 July 2006. Five submissions were received for 05/03 and four for 05/04.
Further submissions closed on 15 September 2006. Six further submissions were received for 05/03 and four for 05/04.
A hearing was held on 18 December 2006 where a Hearing Committee made recommended decisions. These recommended decisions were approved at a meeting of full Council on 1 March 2007. No appeals were received.
Outcome
Following a Full Council meeting on 24 May 2007, public notice was given on 26 May 2007 that the above plan changes (as amended) will become Operative on 5 June 2007. The Nelson Resource Management Plan has been amended.
